A gym owner arrested while holding an exercise class on a sidewalk in front of his business in Bogota during the coronavirus pandemic has filed a federal lawsuit against the borough for false arrest and malicious prosecution.
Carlos Bernal, 45, of Ridgefield Park, claims in court papers he was handcuffed in front of his 10-year-old son and two gym clients after he refused to show a police officer his identification or give his home address.
The incident occurred shortly after 9 a.m. on Sept. 11, 2020, in front of the gym in the 200 block of Leonia Avenue in Bogota, according to the lawsuit, filed Aug. 13 in U.S. District Court.
